Terms of Sale and Services

These Terms of Service and Terms of Sale (“Terms”) govern your use of the Fusion Fast Print website and your purchase of products and services from Fusion Fast Print (“Fusion Fast Print,” “we,” “our,” or “us”).

By placing an order, requesting a quote, submitting artwork, approving a proof, or using our website or services, you agree to these Terms.

1. Services

Fusion Fast Print offers custom printing and customization services, including but not limited to:

  • Custom apparel and T-shirts
  • Engraving and personalized items
  • Banners, signs, decals, stickers, and printed materials
  • Vehicle wraps
  • Other customized products and printing-related services

All orders are subject to acceptance by Fusion Fast Print.

2. Quotes and Orders

Quotes are estimates based on the information available at the time they are prepared, including quantity, materials, size, finishing, artwork, timeline, and delivery method.

A quote does not guarantee availability, scheduling, or final pricing until the order is accepted by us.

We reserve the right to refuse, cancel, or limit any order at our discretion, including where materials are unavailable, artwork is problematic, instructions are unclear, pricing errors occur, or content violates law or these Terms.

3. Customer-Supplied Artwork and Instructions

You are solely responsible for all content, artwork, spelling, grammar, names, numbers, dimensions, colors requested, layout instructions, and other materials you provide to us.

This includes responsibility for:

  • Typographical errors
  • Misspellings
  • Low-resolution or poor-quality files
  • Incorrect sizing
  • Incorrect dimensions
  • Wrong colors requested or approved
  • Incorrect quantities
  • Incorrect addresses or shipping details
  • Any errors contained in customer-supplied files or instructions

Our job is to print and produce based on the materials, files, and approvals you provide.

As a courtesy, we may point out obvious issues we notice before production, such as visible artwork quality problems, formatting issues, or possible text errors. However, we are not obligated to proofread, redesign, edit, or verify customer-submitted content unless specifically agreed in writing.

If you want design, editing, file repair, color correction, or prepress assistance, that must be separately requested and may involve additional charges and production time.

4. Customer Representations and Intellectual Property

By submitting any artwork, files, text, logos, trademarks, images, or other content, you represent and warrant that:

  • You own the content or have all necessary rights, licenses, permissions, and authority to use it
  • The content does not infringe or violate any copyright, trademark, privacy, publicity, or other rights of any person or entity
  • The content does not violate any law or regulation
  • The content is not defamatory, obscene, hateful, threatening, or otherwise unlawful

You agree to indemnify and hold Fusion Fast Print harmless from claims, losses, damages, liabilities, costs, and expenses arising from customer-provided content.

5. Proofs and Approval

Where a proof is provided, it is the customer’s responsibility to review it carefully before approving production.

Approval of a proof confirms that you accept all visible details, including:

  • Spelling
  • Grammar
  • Layout
  • Design placement
  • Dimensions shown
  • Colors as represented in the proof
  • Quantity/specifications reflected in the proof or order summary

Once a proof is approved, production may begin, and changes may no longer be possible. Any requested changes after approval may result in additional charges, delays, or cancellation of the original production schedule.

If no proof is provided for a particular job, production may proceed based on the files and instructions you submitted.

6. Color, Material, and Production Variations

Because of differences in screens, printers, inks, materials, fabrics, substrates, finishing methods, and production processes, final products may vary slightly from:

  • On-screen previews
  • Previous orders
  • Pantone or color references not specifically contracted for
  • Mockups
  • Samples
  • Customer expectations based on non-production displays

Minor variations in color, placement, alignment, trim, folds, finish, engraving depth, material texture, or size are normal in custom manufacturing and printing and do not automatically qualify as defects.

7. Customer-Supplied Items / Bring-Your-Own Goods

If you provide your own garments, blanks, cups, tumblers, materials, or other items for customization:

  • You accept the risk that some items may not be suitable for the requested process
  • We are not responsible for hidden defects, manufacturing flaws, surface coatings, inconsistent materials, heat sensitivity, breakage risk, or compatibility issues
  • We are not liable for damage, spoilage, or unsatisfactory results caused by the nature or condition of customer-supplied items, except to the extent caused solely by our gross negligence or willful misconduct

Not all items are suitable for all decoration or customization methods. We may decline to work on customer-supplied items at our discretion.

8. Turnaround Times

Any production or delivery time quoted by us is an estimate unless expressly guaranteed in writing.

Turnaround time begins only after all required items have been received, including:

  • Final artwork
  • Complete instructions
  • Required approvals
  • Payment or deposit, if applicable
  • Necessary blanks or materials

We are not responsible for delays caused by late approvals, customer changes, incomplete information, supplier issues, shipping carriers, force majeure events, equipment failure, or other causes beyond our reasonable control.

9. Shipping, Delivery, Pickup

Risk of loss may pass to the customer upon pickup, delivery to the carrier, or tender for shipment, depending on the transaction.

Customers are responsible for verifying shipping addresses and delivery details. Fusion Fast Print is not responsible for delays, loss, or damage caused by carriers, incorrect addresses provided by the customer, failed delivery attempts, or events outside our control.

Customers should inspect delivered or picked-up orders promptly.

10. Payment

Payment terms may require full payment, partial payment, or a deposit before production begins.

Unless otherwise agreed in writing:

  • Prices are in U.S. dollars
  • Applicable taxes, shipping, rush fees, design fees, setup fees, and special handling charges may be added
  • Orders may be held until required payment is received
  • Unpaid balances may delay production, release, delivery, or pickup

We reserve the right to correct pricing errors, calculation errors, and obvious mistakes before accepting or fulfilling an order.

11. Cancellations and Changes

Because many of our products are custom-made, cancellations and changes may not be available after production preparation has started.

If a cancellation is requested:

  • Before design/prepress/production work begins, we may approve cancellation in our discretion
  • After design work, setup, material ordering, customization, or production begins, charges may apply for work already performed, materials committed, and administrative costs
  • Once a custom item is completed, cancellations are not available

Any approved order changes may require additional charges and revised turnaround times.

12. Returns, Refunds, and Reprints

Because most products are customized or made to order, all sales are generally final.

We do not offer refunds, returns, or exchanges for:

  • Customer spelling or text errors
  • Customer-approved proof errors
  • Low-quality customer artwork
  • Incorrect files or instructions supplied by the customer
  • Color expectations based on screens or unofficial samples
  • Minor production variations within commercially reasonable tolerances
  • Change of mind after approval or production

If there is a defect caused by us, you must notify us in writing within 3 business days of delivery or pickup and provide clear photos and a description of the issue.

If we determine that an error was caused by Fusion Fast Print, our sole remedy, at our option, will be one of the following:

  • Reprint
  • Repair
  • Replacement
  • Store credit
  • Partial refund

We may require return of the product, inspection, or additional information before deciding the appropriate remedy.

13. Refusal of Content

We reserve the right to refuse to print, engrave, customize, publish, or produce any content that we determine, in our discretion, is unlawful, infringing, misleading, threatening, defamatory, obscene, discriminatory, hateful, or otherwise inappropriate.

14. Website Use

You agree not to use our website to:

  • Violate any law
  • Upload malicious code
  • Interfere with website security or functionality
  • Harvest data unlawfully
  • Submit false, misleading, or infringing content
  • Abuse quote forms, messaging channels, or ordering systems

We may suspend or restrict access for misuse.

15. Limitation of Liability

To the fullest extent permitted by law, Fusion Fast Print will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business, lost opportunity, loss of data, or reputational harm arising out of or related to any order, service, website use, delay, or product.

Our total liability for any claim relating to a product or service shall not exceed the amount actually paid by the customer for the specific order giving rise to the claim.

16. Indemnification

You agree to defend, indemnify, and hold harmless Fusion Fast Print and its owners, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of:

  • Your artwork or content
  • Your breach of these Terms
  • Your misuse of the website or services
  • Your violation of any law or third-party right

17. No Warranty

Except as expressly stated in writing, all products and services are provided “as is” and “as available.” To the fullest extent permitted by law, Fusion Fast Print disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

18. Force Majeure

Fusion Fast Print is not responsible for failure or delay caused by events beyond our reasonable control, including acts of God, severe weather, fire, flood, supply shortages, labor disruptions, internet outages, equipment breakdown, governmental action, transportation delays, or other unforeseen events.

19. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

Any dispute arising from these Terms or any transaction with Fusion Fast Print shall be brought in the appropriate state or federal courts located in Florida, unless otherwise required by law.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a revised effective date. Continued use of our website or services after the effective date of revised Terms constitutes acceptance of the updated Terms.
